Restitution is a basic legal principle that seeks to avoid unjust enrichment and to put the parties back in the position they were in before the benefit was unjustly acquired. Restitution is based on the principles of equity, fairness and corrective justice and works by taking away the benefits gained rather than just the losses suffered. The article discusses the theoretical underpinnings of restitution, its close connection with the doctrine of unjust enrichment and its growth as an autonomous area of law. It examines the statutory provisions on restitution in India with a focus on the provisions of the Indian Contract Act, 1872 and Section 144 of the Code of Civil Procedure, 1908, both of which are concerned with the prevention of retention of benefit without just cause. The study also examines the wide scope of restitution through landmark judgments of the Supreme Court of India, which have considered restitution as an important tool to secure substantive justice and avoid abuse of judicial processes. Moreover, the article shows the relevance of restitution in the present day in fields like taxation, environmental protection, commercial transactions, public law and digital payments. It points to new issues, such as the lack of a comprehensive legal system and the need for a more conceptualised approach to restitution law. The article concludes that restitution is a dynamic and indispensable legal doctrine that is vital to the administration of justice because it provides justice, corrects the injustice of enrichment, and re-establishes the balance of justice between parties.
