The key legal issues include:

  • INTERIM MEASURES UNDER SECTION 9: Maintainability of an application under Section 9 of the Arbitration and Conciliation Act, 1996, when the arbitral tribunal has already been constituted and Section 17 is available.

  • CHALLENGE TO AN ARBITRATOR: Issues concerning the challenge to an arbitrator’s appointment or continuation after the arbitral tribunal has rejected the challenge.

  • DISCLOSURE OF TECHNICAL RECORDS: Preservation and production of commercially sensitive technical and software records during arbitration.

  • TERMINATION OF A TECHNOLOGY SUPPLY AGREEMENT: Termination on account of alleged defects and the supplier’s opportunity to cure those defects.

  • LIMITATION OF LIABILITY: Recovery of recall expenses and postponed-launch losses under a contractual limitation-of-liability clause.
