INTRODUCTION
On June 19, 2026, the Delhi High Court delivered a landmark verdict in Telegram FZ LLC v. Union of India[1], upholding an emergency directive to block the messaging platform nationwide. This unprecedented administrative intervention was triggered by an acute public order crisis: organised cheating syndicates weaponizing Telegram to compromise the integrity of the upcoming NEET-UG re-examination. While the judiciary validated the temporary blackout to prevent massive paper-leak fraud, the ruling establishes a highly controversial precedent for internet governance.
The state’s forceful exercise of administrative discretion to secure a national exam ultimately severed 150 million innocent Indian users from everyday digital access. This dramatic expansion of executive blocking powers tests constitutional boundaries, prioritising immediate public order at the high cost of suspending fundamental digital rights.
This development raises three pivotal constitutional questions that this manuscript examines:
- Whether the expansion of Section 69A to cover entire platform architectures violates the principle of ultra vires regarding statutory intent?
- To what extent does the judicial recognition of ‘architectural liability’ alter the established intermediary safe harbour protections under Section 79?
- Does a time-bound, platform-wide blackout satisfy the strict ‘least restrictive means’ requirement under the constitutional test of proportionality?
EXPANDING SECTION 69A: THE STATUTORY INTERPRETATION OF “INFORMATION”
Historically, Section 69A of the Information Technology Act, 2000[2], served as a tool for surgical, content-specific censorship. The executive traditionally exercised these emergency blocking powers to target discrete web pages, malicious URLs, or specific social media accounts, ensuring the broader digital platform remained completely untouched. This narrow application respected the architecture of the internet, isolating unlawful content without dismantling the host infrastructure. By treating platforms as neutral conduits, administrative interventions were highly localised, minimising collateral damage and ensuring that the public’s access to legitimate, everyday digital communication was never compromised.
However, the Delhi High Court’s strict, literal reading of Section 2(1)(v)[3] fundamentally alters this statutory scope. Telegram advanced a textualist defence, arguing that Section 69A only permits blocking specific “information” or content, not an entire communication intermediary. Justice Tejas Karia dismantled this distinction by focusing on the statutory definition of “information,” which explicitly encompasses codes, computer programs, software, and databases.
The court reasoned that because a digital application is entirely a compilation of these functional elements, the software itself legally constitutes “information”. Consequently, the state is now empowered to execute platform-wide bans under the guise of content moderation. This expansive paradigm shifts the law’s focus from policing unlawful user speech to entirely prohibiting the software infrastructure that enables it.
By applying these targeted rules to an entire network infrastructure via emergency powers, the High Court allows Section 69A to swallow the critical intermediary safe harbour protections guaranteed under Section 79. Transforming a surgical moderation tool into a blunt instrument for total infrastructure control ultimately strips platforms of legal immunity and silences millions of lawful originators simultaneously.
By expanding the definition of ‘information’ to encompass the entire functional software infrastructure, the ruling effectively bypasses these built-in procedural checks. This expansion conflicts with the foundational premise of Shreya Singhal v. Union of India[4], where the Supreme Court upheld Section 69A precisely because its application was narrowly tailored, surgical, and subject to strict procedural safeguards.
THE BIRTH OF “ARCHITECTURAL LIABILITY”
The emergence of ‘architectural liability’ marks a significant departure from the standard due diligence frameworks established under Section 79 of the IT Act and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Historically, intermediary liability in India has been predicated on actual knowledge and a subsequent failure to act (the ‘notice-and-takedown’ model), as affirmed in Google India Pvt. Ltd. v. M/s Visaka Industries.
By holding a platform liable for its ‘privacy-by-design’ features—such as message-editing options and cloud-based architecture—the court shifts the legal standard from behavioral compliance (removing flagged URLs) to structural compliance (altering platform engineering). This sets a demanding precedent where technical resilience itself becomes a source of legal vulnerability.
The government argued that features explicitly engineered to protect user privacy (such as cloud-based infrastructure, username-driven operations masking phone numbers, and the ability for a single user to create up to 40 automated bots) were weaponised by cheating syndicates. Most critically, the state highlighted a severe technological vulnerability in Telegram’s message-editing feature.
Expert technologists demonstrated how scammers exploited this function to orchestrate “backdating scams”. By silently swapping a benign PDF with a fabricated “leaked” exam paper while retaining the original timestamp, fraudsters successfully manufactured highly convincing, after-the-fact evidence of a paper leak. This induced mass panic among candidates and forced the platform’s founder to concede the vulnerability, an admission the state weaponised to justify disabling the feature entirely.
The court seized upon this architectural resistance to justify bypassing targeted interventions, heavily weighing the practical enforcement challenges cited by the government. The platform’s architecture enabled syndicates to instantly create replacement mirror channels to evade enforcement. Because the circulation of fabricated materials continued unabated through these backup networks, the judiciary concluded that narrower regulatory measures were structurally ineffective against such a resilient ecosystem.
TESTING PROPORTIONALITY: A CRITIQUE OF THE COURT’S BALANCING ACT
To validate the severe infringement on digital rights, the Delhi High Court subjected the emergency blocking order to the rigorous four-pronged proportionality test formulated by the Supreme Court in Anuradha Bhasin v. Union of India[5].
The court found that the first three prongs of this constitutional framework were satisfied by the state’s intervention. First, a “legitimate goal” existed because the government sought to safeguard the integrity of the national NEET-UG examination and prevent large-scale fraud. Second, a “rational nexus” was established, as blocking the platform directly halted the unmoderated circulation of fabricated materials. Third, the court accepted the “necessity” of the measure, ruling that no less restrictive, equally effective alternative existed. Due to the rapid creation of mirror channels and automated bots, the judiciary deferred heavily to executive discretion, concluding that traditional, targeted URL takedowns were structurally incapable of neutralising the immediate threat to public order.
However, the court’s application of the “least restrictive means” requirement deserves severe scrutiny, as it signals a troubling shift in how judicial control balances state power against individual liberties. Historically, the state must empirically prove it has exhausted all intermediate technical measures before resorting to an absolute ban. By accepting architectural complexity as a structural barrier to narrower interventions, the Court arguably lowered the threshold for executive discretion under the ‘least restrictive means’ standard.
An undifferentiated platform-wide ban impacts the entire user base, raising critical questions regarding the overbreadth of the administrative remedy in relation to the specific unlawful conduct of a distinct subset of actors.
While the state possesses a compelling interest in preserving examination integrity, the complete suspension of a communication network under the guise of content moderation requires rigorous empirical justification to survive constitutional scrutiny.
Furthermore, because determined fraudsters can seamlessly bypass such network blocks using Virtual Private Networks (VPNs), the total embargo inflicts massive collateral damage on lawful students and professionals while failing to achieve absolute technical efficacy against the targeted criminals.
Most concerning is the court’s flawed reliance on “temporality” to satisfy the final balancing stage of the Anuradha Bhasin[6] framework. By emphasising that the platform block would lift immediately after the June 21 exam, the judgment erroneously suggests that unprecedented digital censorship is constitutionally permissible as long as it is temporary. A strict time limit does not cure the fundamental constitutional defect of a mass communication blackout. Using a time-bound window as a proxy for proportionality allows the executive to hollow out substantive fundamental rights. It sets a heavy-handed precedent where the widespread suspension of digital access is excused, ignoring the immediate, real-world disruption inflicted upon millions of citizens.
CONCLUSION: THE NEW PRECEDENT FOR DIGITAL ACCESS
The Delhi High Court’s ruling signals a profound paradigm shift in Indian internet governance. While past platform-wide bans were strictly anchored in extraordinary claims of national security and sovereign defence, this verdict normalises comprehensive application blackouts for domestic public order concerns and administrative failures. By allowing Section 69A[7] to be utilised as a blunt instrument to manage examination fraud, the judiciary has significantly lowered the threshold for extreme state intervention, establishing a highly permissive precedent that expands executive intervention in domestic public order matters.
Consequently, this validation of architectural liability casts a severe chilling effect over the entire tech ecosystem, placing secure, privacy-by-design intermediaries in regulatory jeopardy. Platforms utilising end-to-end encryption or decentralised hosting may see their statutory safe harbours nullified if their secure structures hinder state monitoring. Ultimately, the tension between public order and digital rights requires a framework that does not treat engineering resilience as an inherent legal liability.
While the protection of national examinations is an undeniable state priority, judicial oversight must ensure that infrastructure-wide remedies do not outpace constitutional safeguards. A balanced approach requires the state to develop sophisticated regulatory and technological capabilities to counter automated networks, ensuring that the digital access of the wider public is preserved even during critical administrative crises.
